When you visit our website including our social media pages (Sites), these terms and conditions (Terms) form a binding agreement between us. If you do not agree with these Terms, you should not order our Products or visit our Sites.
OUR PRODUCTS AND SITES ARE NOT INTENDED FOR USE IN EMERGENCY SITUATIONS AND ARE NOT A REPLACEMENT FOR MEDICAL ADVICE.

Our Services
1. Bumpies is a registered business ABN 63 634 197 292. We supply first aid related products specifically made for children to support them with their bumps and bruises.
2. Our Products are not a substitute for medical attention. They are only suitable for every day bumps and bruises. Parents and carers should use their judgement about when the Products are suitable and when medical attention is required. If at all unsure, use a Nurse on Call type service or call your GP. In an emergency, use 000.
3. On our Sites, we also offer education and information (Information) to improve first aid outcomes for families.
4. Any Information is provided to increase your first aid knowledge and awareness to assist you to make decisions about how you respond in situations requiring first aid. We cannot guarantee any particular outcomes.
5. Any Information we offer is based on our experience and training on a no liability basis. This is because we offer general information about common scenarios without tailoring that information to any particular person or situation. In reality, you will find yourself in a wide variety of situations which are impacted by medical history, background circumstances and other matters that apply in the specific situations you may find yourself in. It is impossible for us to cover every scenario.
6. You must not use any Information to diagnose, treat, cure or prevent any disease or illness, or as a substitute for specific advice from a health professional.
7. It is your responsibility at all times to ensure a safe and appropriate response to your child. There is no one size fits all approach. You are responsible for exercising your own judgement in each individual circumstance.
8. There are occasions where your child may not respond to the Products or methods we educate you about for various reasons including underlying medical issues. First aid information should be your first line of response only and implemented in conjunction with advice from your GP and where relevant, emergency services such as calling 000, arranging an ambulance or taking your child to an emergency room.

Orders
10. Prices for our products are subject to change without notice. The price that applies will be as confirmed in our order confirmation given to you.
11. We accept payment for products via the payment methods included on our website. Payment providers may have their own terms and conditions which apply in addition to ours. It is your responsibility to familiarise yourself with them.
12. After you make payment for your order, you will receive a transaction confirmation email which confirms receipt of your order. Your order is not binding on us until you receive this confirmation email.
13. If we need to cancel your order for any reason, we will refund all amounts paid by you.
14. If there is a problem with a product that you order, please notify us within 3 days of receiving it.
15. Please take care when entering your shipping details as we do not track your items and cannot amend those details after the order is placed in our system. If you do not have a safe place for an order to be left, please use a parcel locker.
16. We reserve all intellectual property rights in our products. We ask that you do not copy our business. If you like what you see, contact us about us supplying or partnering with you.
17. Descriptions of items are subject to change at any time without notice. We reserve the right to discontinue any item at any time. Whilst we make every reasonable effort to display the Items as accurately as possible, the colors and images of the Items as they appear on our Sites may vary from how they appear in person. We cannot guarantee that your device will display any colors and images accurately.
18. Our liability to you for any incorrect listings is limited to amending or withdrawing that item once we are made aware of it.
19. Some items may present potential hazards for young children and infants. You use the items at your own risk and must take responsibility for informing yourself and managing those risks for your family including storing them away from the reach of children and using them under appropriate supervision.
20. It is your responsibility to familiarise yourself with the items, to read all product labels and warnings and to ensure that they are suitable for your intended use including any medical conditions any person may have. We do not make any guarantees that the items are safe or recommended for any particular use.
Cancellation Policy
21. We reserve the right to cancel any order for any reason in our absolute discretion without any liability to you. Where we do so, we will refund any amounts paid by you for the affected booking or product(s).
22. We will not be liable for any delay or failure to perform our obligations if such delay is due to any circumstances beyond our reasonable control.

Liability
24. We will not be liable for any delay or failure to perform our obligations if such delay is due to any circumstances beyond our reasonable control.
25. To the maximum extent permitted by law, our liability to you is limited to refunding any amounts paid by you in respect of the affected product or service, and if no amounts have been paid then $100.
25. Whilst we take reasonable care in producing our Products and Information, to the maximum extent permitted by law, we exclude any liability for any injury, illness, death, loss or damage caused by use of the Products or Information produced by us.

Bumpies, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors are not liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from any delays or failure in relation to delivery of the Items, your use of any of the Products, Sites or any Information or items procured using the Sites, or for any other claim related in any way to your use of the Products, Sites or any Information or item, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content or product posted, transmitted, or otherwise made available via the Sites, even if we are made aware of their possibility.
28. First aid is an area subject to continuing research, clinical experience, reasonable differences in opinions among authorities, unique aspects of individual situations and the possibility of human error in preparing information.

We make no representation or warranty (express or implied) as to the currency, completeness, accuracy, reliability, suitability, fitness for purpose, non-infringement of third party rights and / or availability of any items, products, services, information or Sites, or that the items, products, services information or Sites will meet expectations or any person’s health or medical requirements.
30. You agree to indemnify and hold us harmless in respect of any third party claims arising as a result of your breach of these terms and conditions or your breach of any law or the rights of a third party.
31. We may assign our rights under these Terms and will provide you notice if we do so.
32. We may vary these Terms and they will apply to any purchase after the varied Terms are published on our website. It is your responsibility to check for updates.
33. These Terms form the whole agreement between us and may not be varied orally.
34. The laws of Victoria, Australia apply to these Terms.
35. If any provision of these Terms is found to be unenforceable or unlawful, it is to be severed and the remaining provisions shall continue in force.
